Personal data (usually referred to simply as "data" below) is processed by us only to the extent necessary and for the purpose of providing a functional, user-friendly website and the services offered on it. Under Art. 4 No. 1 GDPR, "processing" means any operation performed on personal data — such as collection, recording, storage, use, disclosure, restriction, erasure or destruction — whether automated or not.

II · The rights of users and data subjects
With regard to the data processing described in more detail below, users and data subjects have the right:
- to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. Art. 15 GDPR);
- to correct or complete incorrect or incomplete data (cf. Art. 16 GDPR);
- to the immediate deletion of data concerning them (cf. Art. 17 GDPR), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR;
- to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. Art. 20 GDPR);
- to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (cf. Art. 77 GDPR).
In addition, the controller is obliged to inform all recipients to whom it discloses data of any corrections, deletions or restrictions on processing per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply where such notification is impossible or involves a disproportionate effort. Users nevertheless have a right to information about these recipients.
Under Art. 21 GDPR, users and data subjects also have the right to object to the controller's future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.
III · Information about the data collecting
- When you download, register with, or use our App, we may ask you to provide information by which you may be personally identified, such as name, age, email, body weight and height. You need to register and log in to your account to use the QUS Sports app.
- When first using QUS Sports, we collect your height, weight and exercise settings (e.g. exercise goals, heart rate zones, metric settings), device position, exercise track, exercise type (walking, running, etc.), exercise duration, distance, calories, climb rate and vital data such as heart and respiration rate. We collect this data in order to record your daily sport data and provide you with a personalised sport service.
- Usage detail: when you access and use the App, we may automatically collect certain details of your access and use, including traffic data, logs and other communication data, based on the resources you access and use on or through the App.
- Stored information and files: the App may also access metadata and other information associated with other files stored on your device — this may include, for example, photographs.
- Location information: this App collects real-time information about the location of your device. If you would like to use the outdoor sports function, we will ask whether you allow us to obtain your location data via the device GPS signal, since outdoor sport requires location data as a sports-path record. You can modify the location settings of your device at any time.
- Where you receive notifications about your account, we collect this data as well as data you publicly share, such as heart rate, breathing rate, distance, high speed and training time.
- QUS uses the information we collect to fulfil the obligations outlined under the Terms of Service — for example, we use heart rate data to provide detailed workout analysis including heart rate graphing and calorie-burn information.
- To protect network security, ensure normal operation and secure your account, and to improve and optimise your experience, we may collect data about your device and how you and your device interact with QUS Sports, including device name, device model, operating system version and other device data.
IV · Information about the data processing
Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided this does not breach any statutory storage obligations or unless otherwise stated below.
Server data
For technical reasons — in particular to ensure a secure and stable website — the following data sent by your internet browser to us or to our server provider is collected: the type and version of your browser, the operating system, the website from which you came (referrer URL), the pages of our site you visit, the date and time of your visit, and the IP address from which you visited our site.
This data is temporarily stored, but not in association with any other of your data. The legal basis is Art. 6 Para. 1 lit. f) GDPR; our legitimate interest lies in the improvement, stability, functionality and security of our website. The data is deleted within no more than seven days, unless continued storage is required for evidentiary purposes, in which case the relevant data is excluded from deletion until the relevant incident is finally resolved.
Cookies — a) Session cookies
We use cookies on our website. Cookies are small text files or other storage technologies stored on your computer by your browser. They process certain specific information about you, such as your browser, location data or IP address, making our website more user-friendly, efficient and secure. The legal basis is Art. 6 Para. 1 lit. b) GDPR insofar as cookies are used to initiate or process contractual relationships; otherwise our legitimate interest in improving functionality applies, with Art. 6 Para. 1 lit. f) GDPR as the legal basis. Session cookies are deleted when you close your browser.
Cookies — b) Third-party cookies
Where necessary, our website may also use cookies from companies with whom we cooperate for the purpose of advertising, analysing or improving the features of our website. Details of the legal basis and purpose of such third-party collection and processing are set out below.
Cookies — c) Disabling cookies
You can refuse the use of cookies by changing your browser settings, and you can delete cookies that have already been stored. The steps required vary depending on the browser. If you prevent or restrict the installation of cookies, not all functions of our site may be fully usable.
Order processing
The data you submit when ordering goods and/or services from us is processed in order to fulfil your order; orders cannot be processed without this data. The legal basis is Art. 6 Para. 1 lit. b) GDPR. After your order is completed, your personal data is deleted, subject to the retention periods required by tax and commercial law. To process your order, we share your data with the shipping company and/or payment service provider to the extent required (Art. 6 Para. 1 lit. b) GDPR).
Customer account / registration
If you create a customer account via our website, we use the data you entered during registration (e.g. name, address, email address) exclusively for services leading up to a potential order or other contractual relationship, to fulfil such orders or contracts, and to provide customer care. We also store your IP address and the date and time of your registration. This data will not be transferred to third parties. Your consent is obtained during registration (Art. 6 Para. 1 lit. a) GDPR); where the account also serves to initiate or fulfil a contract, Art. 6 Para. 1 lit. b) GDPR also applies. You may revoke your consent at any time with future effect under Art. 7 Para. 3 GDPR, subject to statutory retention periods.
Newsletter
If you register for our free newsletter, the data requested for this purpose — your email address and, optionally, your name and address — is sent to us. We also store your IP address and the date and time of registration. Your consent is obtained during registration (Art. 6 Para. 1 lit. a) GDPR). The data is used exclusively to send the newsletter and is not passed on to third parties. You may revoke your consent at any time with future effect, or use the unsubscribe link in each newsletter.
Contact
If you contact us via email or the contact form, the data you provide is used to process your request (Art. 6 Para. 1 lit. b) GDPR). Your data is deleted once we have fully answered your inquiry and there is no further legal obligation to store it.
Social media links via graphics
We integrate the following social media sites via a linked graphic of the respective site. These graphics are stored on our own servers, which prevents an automatic connection to the networks' servers on display. Only when you click the corresponding graphic are you forwarded to the respective network, which may then record information about you and your visit — it cannot be ruled out that such data is processed in the United States. If you are logged into the network, it may assign the visit to your account. To prevent this, log out of the relevant account before clicking. The following networks are integrated via linked graphics: Facebook (Meta Platforms Ireland Ltd., Dublin), YouTube (Google Ireland Ltd., Dublin) and LinkedIn (LinkedIn Ireland Unlimited Company, Dublin). Please refer to each provider's privacy policy for details.
Google Analytics
We use Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The service analyses how our website is used; the legal basis is Art. 6 Para. 1 lit. f) GDPR, our legitimate interest being the analysis, optimisation and economic operation of our site. Usage and user-related information (such as IP address, place, time and frequency of visits) is transmitted to a Google server and stored there. We use Google Analytics with IP anonymisation, whereby your IP address is truncated within the EU/EEA before transmission. Google provides further information and opt-out options at policies.google.com/privacy and via the opt-out add-on at tools.google.com/dlpage/gaoptout.
Jetpack — WordPress Stats
Our website uses Jetpack with the WordPress Stats extension, a web-analysis service provided by Automattic Inc., 132 Hawthorne Street, San Francisco, CA 94107, USA. It analyses how our website is used (Art. 6 Para. 1 lit. f) GDPR). Data such as your IP address, the pages you visit, the referrer URL, the duration and frequency of your visits is processed and stored on an Automattic server; your IP address is anonymised immediately after processing. You can prevent the installation of cookies via your browser settings.
Google Maps
Our website uses Google Maps (Google Ireland Limited, Dublin) to display our location and provide directions. When you access the integrated Google Maps components, Google stores a cookie on your device and processes your settings and data to display our location and create a route. We cannot prevent Google from using servers in the USA. The legal basis is Art. 6 Para. 1 lit. f) GDPR. Use of Google Maps is also governed by the Google Terms of Use and the Google Maps terms.
Google reCAPTCHA
Our website uses Google reCAPTCHA (Google Ireland Limited, Dublin) to check and prevent automated access ("bots"). This allows Google to determine the website and IP address from which the request was sent; Google may collect additional information necessary to provide the service. The legal basis is Art. 6 Para. 1 lit. f) GDPR — our legitimate interest in the security of our website and the prevention of spam and similar automated access. See policies.google.com/privacy.
YouTube
We use YouTube (YouTube LLC, San Bruno, CA, a subsidiary of Google Ireland Limited) in advanced privacy mode. The legal basis is Art. 6 Para. 1 lit. f) GDPR, our legitimate interest being to improve the quality of our website. In advanced privacy mode, data is only transmitted to the YouTube server once you actually start a video; YouTube then records at least your IP address, the date and time, and the website visited, and a connection to Google's DoubleClick network is established. If you are logged into YouTube, the connection is assigned to your account unless you log out beforehand. See policies.google.com/privacy.
MailChimp — Newsletter
We offer newsletter registration via MailChimp, a service of The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318, USA. If you register, your email address and, optionally, your name and address are processed by The Rocket Science Group, along with your IP address and the date and time of registration. The newsletter contains a tracking pixel ("web beacon") that helps us evaluate whether and when you read it and whether you clicked any links, so we can optimise our newsletter. The legal basis is Art. 6 Para. 1 lit. a) GDPR. You may revoke your consent at any time with future effect, or use the unsubscribe link in each newsletter. V · The purposes for which we collect and process data
- To provide you with the products and services, or otherwise fulfil the reason for which you provided the information.
- To provide support and respond to your inquiries, including to investigate user-reported issues and address your concerns by monitoring and improving our responses to errors.
- To provide, support, personalise, improve, analyse and develop our products and services for user experience and operational stability.
- To notify you about changes to our services, where applicable.
- To notify you of app updates and changes to any product or service we offer.
- To help maintain the safety, security and integrity of our products, services, databases and other technology assets.
- To detect, prevent and address technical issues.
QUS will not use your health data for marketing or advertising purposes.
VI · How users may request deletion of data
You may choose to delete some of the data you have submitted to us. For some personal data, you can delete it directly on the relevant function pages of the products or services:
- Delete your local data via Settings App → App Management → App List → QUS Sports → Storage Usage → Clear Data.
- Delete your local data by uninstalling QUS Sports.
- Delete your cloud data via Settings → Cloud sync → Clear Personal Data in Cloud.
- Delete your local and cloud data via the delete option in the application.
You may request that we delete your personal data by contacting us at info@qus.tech in the manner disclosed in this privacy policy. If we have not yet provided you with a channel for deletion, or if we violate our agreement with you in the collection and use of your personal data, you may contact us and request deletion in the manner disclosed here.
